1. Agreement to Terms

By accessing or using Flagup, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Definitions

  • "Service" refers to the Flagup feedback and roadmap platform.
  • "User" refers to any individual or entity utilizing the Service.
  • "Customer Data" refers to feedback, logs, or content submitted by your end-users.

3. Eligibility & Age Requirement

You must be at least 18 years of age to create an account and use this Service. If you are between 13 and 17 years old, you may only use the Service with the explicit consent and active supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

The Service is not intended for children under the age of 13. We do not knowingly permit anyone under 13 to register for or use the Service. If we become aware that an account belongs to a user under 13, we will immediately suspend that account and permanently delete all associated data without notice.

By registering for an account, you represent and warrant that you meet the age requirements above and have the full legal capacity to enter into this agreement.

4. Account Registration

To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Subscription & Payment

Flagup offers various subscription plans. Fees are non-refundable except as required by law or specified in our Refund Policy. We reserve the right to change our subscription fees upon at least 30 days' notice.

6. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

7. Acceptable Use

You agree not to use the Service for any unlawful purpose or to:

  • Upload viruses or malicious code.
  • Scrape, crawl, or spider any part of the Service.
  • Post content that is defamatory, obscene, or promotes discrimination.

8. Intellectual Property

Flagup and its original content, features, and functionality are and will remain the exclusive property of Flagup and its licensors. You retain all rights to the Customer Data you upload, but grant us a license to host it solely to provide the Service.

9. AI Features

Flagup may utilize Artificial Intelligence to provide feature summaries and sentiment analysis. While we strive for accuracy, AI-generated content may occasionally contain errors. You are responsible for reviewing and validating AI outputs.

10. Data Privacy & Security

Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and protect your information and that of your end-users.

11. Limitation of Liability

In no event shall Flagup, nor its directors or employees, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

Privacy Policy

1. Introduction

At Flagup, we respect your privacy and are committed to protecting it. This Privacy Policy explains how we collect, use, and safeguard information when you use our feedback and roadmap platform.

2. Information We Collect

Account Data: When you register, we collect your name and email address. Payment details are handled directly by Dodo Payments and are never stored on our servers.

Customer Data: We store the feedback, comments, and upvotes submitted by your end-users to your boards.

Portal Submission Data: When a user submits feedback, a comment, or a vote on a public portal, we store their IP address and browser type for spam prevention and duplicate detection. We do not log general browsing activity.

3. How We Use Your Information

  • To provide, operate, and maintain our Service.
  • To process transactions and manage your subscription.
  • To provide AI-generated insights and feedback categorization.
  • To send administrative emails, such as updates or security alerts.

4. AI Data Processing

Flagup uses Artificial Intelligence to analyze feedback sentiment and summarize requests.

  • We do not sell your data to third-party AI companies.
  • Data sent for AI processing is anonymized wherever possible.
  • You may opt-out of using AI features in your workspace settings.

5. Data Sharing & Sub-processors

We only share data with essential service providers who help us run Flagup, including:

  • Infrastructure: Cloudflare, Hetzner, Nginx, Supervisor
  • Payments: Dodo Payments
  • Analytics: Plausible, Posthog
  • Storage & CDN: Cloudflare R2

6. Your Rights (GDPR/CCPA)

Depending on your location, you have the right to access, correct, or delete your personal data. To exercise these rights, or to request a Data Processing Addendum (DPA), please contact our legal team.

7. Security

We implement industry-standard encryption (SSL/TLS) for all data in transit and at rest.

8. Children's Privacy

Flagup is not directed at children under the age of 13 and we do not knowingly collect personal data from anyone under 13. Users between the ages of 13 and 17 may only use the Service with verifiable parental or guardian consent.

If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at support@flagup.io. We will promptly investigate and delete any such data.

If we discover that we have inadvertently collected personal data from a child under 13, we will delete that data immediately and terminate the associated account.

Cookie Policy

  • Security: To protect your data and our platform from unauthorized access (CSRF protection).
  • Preferences: To remember settings like your language or sidebar collapse state.

4. Third-Party Cookies

We may use third-party services like Dodo Payments (for payments) and Google Analytics (for usage analytics). Analytics scripts are only loaded after you accept cookies through our consent banner. These providers may set their own cookies to ensure their services function correctly. We do not control third-party cookies.

5. Managing Your Preferences

You can manage cookies through your browser settings and remove previously stored cookies at any time. Please note that disabling "Essential" cookies will prevent Flagup from functioning, as you may be unable to log in or save roadmap changes. If you remove the laravel_cookie_consent cookie, the consent banner will be shown again on your next visit.

6. Cross-Subdomain Tracking

To provide a seamless experience, our cookies are set on the root domain .flagup.io. This allows your consent and login status to persist when navigating between your project dashboard (dashboard.flagup.io) and the public feedback portals (*.feedback.flagup.io).

Refund Policy

1. General Policy

At Flagup, we strive to provide a high-quality feedback and roadmap platform. Because we offer a Free Tier and the ability to cancel at any time, we generally do not offer refunds once a billing cycle has processed, except as required by law or in the specific circumstances outlined below.

2. Subscription Cancellations

You may cancel your Flagup subscription at any time through your account settings.

  • Monthly Plans: Cancellation stops future billing. You will retain access until the end of your current billing period.
  • Annual Plans: Cancellation prevents renewal. You will retain access for the remainder of the year you paid for.

3. Exceptional Refund Requests

We review refund requests on a case-by-case basis. You may be eligible for a refund if:

  • Technical Issues: A confirmed technical bug prevented service use for more than 48 consecutive hours.
  • Billing Errors: You were charged twice or there was a clear clerical error in your invoice.
  • Accidental Renewal: For annual plans, if you contact us within 72 hours of the renewal charge.

4. Non-Refundable Items

Refunds will not be issued for:

  • Partial months of service after a cancellation.
  • Accounts terminated due to a violation of our Terms of Use.
  • Cases where you "forgot" to cancel a monthly subscription before it renewed.

5. Chargebacks

We encourage you to contact us directly to resolve billing issues. Initiating a chargeback without contacting us first may lead to permanent account suspension and loss of project data.

6. How to Request a Refund

To request a refund, please email our billing team with your account email and the reason for your request.
